We are located in the heart of rural north-west Worcestershire, in the lea of the Abberley Hills.  Visitors are always welcome, and we can assure you of a warm welcome, and cup of tea!

Standard terms and conditions for the sale and supply of goods

1.         DEFINITIONS
In this document the following words shall have the following meanings:

1.1.         “Buyer” means the person or company who buys the goods from the Seller.

1.2.         “Credit Terms” means the deferral by the Seller of payment for the Goods supplied to the Buyer for a defined period after the order is placed.

1.3.         “Goods” means the articles that the Buyer agrees to buy from the Seller.

1.4.         “List price” means the list of prices of the Goods maintained by the Seller as amended from time to time.

1.5.         “Price” means the total purchase value of the order charged by the Seller (including the List Price, VAT and any delivery charges)

1.6.         “Seller” Means DCC Supplies Ltd. (Registered company number 5687429) with its registered office at Thistledown, Suffolk Lane, Abberley, Worcestershire WR6 6BE. United Kingdom.

1.7.         “Terms and Conditions” Means the terms and conditions of sale set out in this document and any special terms and conditions agreed in writing by the Seller.

 

2.        FORMATION OF CONTRACT BETWEEN BUYER AND SELLER

2.1.         These terms and conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer and shall prevail over any other documentation or communication from the Buyer.

2.2.         All orders for Goods, whether by email, telephone, fax, electronic communication or in person shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these Terms and Conditions and are subject to acceptance by the Seller. The Seller may choose not to accept an order for any reason. The Seller reserves the right to request a deposit of up to 25% of the list price, prior to accepting the order. This deposit is non-returnable in the event of a cancellation by the Buyer.

2.3.         Any variation to these Terms and Conditions shall be inapplicable unless agreed in writing by the Seller.

2.4.         Nothing in these Terms and Conditions shall affect the Buyer’s statutory rights as a consumer.

2.5.    The Buyer warrants to the Seller that he / she is legally capable of entering into binding contracts.

 

3.        PRICE AND PAYMENT

3.1.         The price of the Goods shall be that stipulated in the Seller’s current List Price/on the sellers website/as contained in the Sellers Quotation (as applicable) at the date of order or as agreed in writing between the parties. The Price is inclusive of VAT and exclusive of delivery charges. Details of delivery charges will be provided to you prior to acceptance of the order.

3.2.         Payment of the total purchase Price (including VAT and any delivery charges) must be made in full before despatch of the goods (unless the Buyer has previously agreed Credit Terms with the Seller in writing)

3.3.         Should the Buyer have agreed Credit Terms with the Seller, the Seller reserves the right to claim statutory interest at  8% above the Bank of England base rate at the date the debt becomes overdue in accordance with the Late Payment of Commercial Debts (Interest) Act 1998. The Seller reserves the right to claim late payment fees. These may be debt collection charges or be in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

3.4.         If the Buyer orders Goods for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specific destination. The Buyer will be responsible for payment of any such import duties and taxes and the Seller shall have no responsibility or liability in respect thereof.

 

4.        DELIVERY

4.1.         Delivery of the Goods shall be made by the Seller notifying the Buyer that the Goods are available for collection at the Seller’s premises or for delivery to such place and on such terms as agreed between the Seller and the Buyer at the time the order is placed and accepted.

4.2.         All Goods, wherever possible, will be delivered within 5 days of the order being accepted and the Buyer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery. The Seller reserves the right to make re-delivery and storage charges should the Buyer be unable to accept delivery of the Goods.

4.3.         The Seller shall use its reasonable endeavours to meet any date stated for delivery. In any event time of delivery shall not be of the essence and the Seller shall not be liable for any losses, costs, damages or expenses incurred by the Buyer or any third party arising directly of indirectly out of any failure to meet any estimated delivery date.

4.4.         Some Goods may not be in stock at the time the order is placed. In the event that the Seller is unable to deliver the Goods within the time specified in Clause 4.2, the Seller will contact the Buyer to advise of the situation and the Buyer shall be entitled to cancel the order and receive a full refund or agree a later delivery date.

4.5.         Title shall pass to the Buyer upon full payment of the Price.

4.6.    Risk in the goods shall pass to the Buyer upon delivery of the Goods

 

5.        WARRENTY

5.1.         The Seller warrants that the Goods will at the time of delivery be of satisfactory quality and will remain free from defects arising from faulty workmanship and materials for a period of 12 months from the date of delivery.

 

6.        CANCELLATION, RETURNS AND REFUNDS

6.1.         The Buyer shall inspect the Goods immediately upon receipt and shall notify the Seller within 7 days of delivery if the Goods are damaged or do not comply with terms of the accepted order.

6.2.         Where a claim of defect or damage is made then the Goods shall be returned by the Buyer to the Seller, and the Buyer shall be entitled to replacement Goods or a full refund (including delivery costs, if applicable) plus any return postal charges if the Goods are in fact defective.

6.3.         Goods to be returned must clearly show the order number obtained from the Seller on the package.

6.4.         Where returned Goods are found to be damaged due to the Buyer’s fault the Buyer will be liable for the cost of remedying such damage.

6.5.      If the Buyer is contracting as a consumer and the Goods are purchased via the internet, by mail order, or by phone or fax, the Buyer has the right, in addition to any other rights, to cancel the Goods and receive a refund by informing the Seller in writing or by email within 7 working days beginning on the day after the Buyer received the Goods. Goods must be returned at the Buyer’s cost and be adequately insured during the return journey. The Buyer shall receive a refund of all monies paid for the Goods (including delivery charges, if any) except for return postal charges within 30 days of cancellation. Goods must be returned in the same conditions as they were received.

 

7.        LIMITATION OF LIABILITY

7.1.         The Seller’s liability in connection with any Goods is strictly limited to the purchase of the Goods concerned.

7.2.         Nothing in these Terms and Conditions shall exclude or limit the liability of the Seller for:

7.2.1.               death of personal injury caused by the Buyers negligence;

7.2.2.               fraud or fraudulent misrepresentation; or

7.2.3.               for any matter for which it would be illegal for the Seller to exclude, or attempt to exclude, its liability

7.3.    The Seller shall not be liable under any circumstances to the Buyer or any third party for any loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings or for any indirect or consequential loss or damage of any kind however arising and whether caused by negligence, breach of contract, misrepresentation or otherwise.

 

8.        FORCE MAJEURE

8.1.         Neither party shall be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside of its reasonable control, including but not limited to acts of God, strikes, lockouts, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the party shall be entitled to a reasonable extension of its obligations.

 

9.        SEVERANCE

9.1.         If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid, illegal or unenforceable provision eliminated.

 

10.     GOVERNING LAW AND JURISDICTION

10.1.       These Terms and Conditions shall be governed by and construed in accordance with the law of England and Wales and the parties herby submit to the exclusive jurisdiction of the courts of England and Wales.

We are a specialist UK based company, specialising in Digital command control systems for model railways. Owned by Andy and Fiona Forty, DCC supplies are keen users of technology which helps us provide service way above the staffing levels of the company, and to focus on our customers requirements. Andy is currently to only full-time staff member, and has assistance from Fiona, and Graham on a part-time basis.
Great importance is given to ample stock levels, prompt shipping and keeping our customers informed, for this the internet and email are vital tools, which are integrated by our own software tools enabling us to provide 'big company' service, whilst retaining the friendly, personal service often lacking from the 'big boys'

Our Story.........................

The story starts some years ago, when after some 30 years or so 'doing other stuff' and a little playing with 12" to the foot scale layouts, my son asked me to help him design a layout.  After a few questions it became obvious that he'd outgrown his 'clockwork oval' days, and we started work on a 'proper' model railway.  Out came the 30 year old copies of Railway Modeller I'd so lovingly kept. In my earlier days, I had built and operated a fully cab controlled layout, and the appreciation of the correct working practices that it permitted (I'm the first in generations of our family not to be a railwayman, so I upheld the family honour in other ways!) and I remembered the excitement of inertia control, and feedback controllers.  Meanwhile we had started to research the wiring plan, after a while, and some time on the web we 'discovered' DCC, and the remarkable standard of modern models.  Surely such realism deserved to be controlled as realistically as possible?  A trip to my local model shop re-affirmed my choice of conventional control, after horror stories over a mug of tea.  However, I'm a confirmed gadget freak, so I buried my nose in the web, and magazines, and gained some insight!

My professional background has been in Software development, Plant control (power stations etc!) and latterly communications network design worldwide.  All of my career, I have been developing new ways of using technology, designing solutions to problems, and explaining these concepts to users (and accountants!).  It struck me that DCC was the way I wanted to go in my layout. So we purchased a system, and installed our first decoder - WOW! and with only two wires.................

As my son and I progressed with DCC I became aware that it's possibilities were much more powerful than advertised!  We also became aware of the two wire fallacy, and the need for proper design and planning being just as necessary as with conventional control. A cunning plan was beginning to form......

DCC supplies grew out of the fusion of a passion for railways and railway modelling, and over 25 years in the computer industry.  Add to the mix a mid-life crisis, and growing dissatisfaction with the corporate life and a new concept was born! 

Each railway modeller has their own passion, DCC supplies exists to partner with you to complement your passion. We believe that we can supply the best of the DCC world, and can provide complete solutions, systems and control starter sets, or a single decoder; Just like many others; However we complement this with a series of workshop events, custom services and conversion/upgrade services (fully insured) and the passion and knowledge to back it all up. We have an advice helpline for customers, and plan to develop many other ways of helping you to extract the last gram of enjoyment from our hobby.

We respect choice, and can equally supply conventional controls, and are just as happy to discuss and provide any components you require, we also manufacture and supply our own range of constant lighting kits for conventional DC layouts.  We provide the tools your require and the best of breed equipment & systems.

We have a DCC & Conventional demonstration layout, incorporating 'OO' and 'N' gauge, we also have 'Z',  'O'  & 'G' gauge test tracks.
